Stages of the Property Purchase

Buying property in Spain may initially seem complex, as the process differs from common practices in Estonia. In cooperation with trusted local partner agencies, we provide guidance in Estonian from the initial consultation through to receiving the keys, and, if desired, also after the purchase process is complete.

Consultation and Needs Assessment

During the consultation, we clarify your goals, expectations, and possibilities regarding the purchase of property on the Costa del Sol. We discuss your budget, timeline, preferred areas, and whether you are looking for a home for permanent living, a holiday property, or an investment.

Before presenting specific properties, we conduct a thorough market review and identify areas and price levels that align with the client’s goals. Based on this analysis, we shortlist properties that meet expectations in terms of quality, location, and budget. This results in a carefully considered and well-founded initial selection, providing a solid basis for further decision-making.

During the viewings, we present the selected properties on site. We help assess each property’s strengths, layout, location, and how well it aligns with your goals. 

Legal Due Diligence

Once a selection has been made, a reservation agreement is signed to confirm that the property is reserved and removed from the market. The agreed price and terms are fixed at this stage. The reservation fee is typically between €3,000 and €10,000 and is later deducted from the final purchase price.

Before signing the preliminary agreement, our legal partner carries out a thorough review of the property, including ownership rights, any outstanding debts or encumbrances, building permits and occupancy licences, compliance of the project with local regulations, homeowners’ association terms, as well as applicable taxes and fees.

 

After the legal due diligence has been completed, a preliminary agreement is signed with the seller.
At this stage, the purchase terms are confirmed and the first instalment is paid, typically 10% of the purchase price. In the case of new developments, the construction timeline and payment schedule are also agreed upon. 

The notary verifies the accuracy of the documentation, registers the transaction in the official registry, and ensures that ownership is transferred to the buyer without hidden risks. After completion, the keys are handed over.
