Terms of Service

The terms and conditions of the free sales appraisal service are valid from 25.03.2025.

These terms of service (hereinafter referred to as the “Terms”) set out the general terms and conditions under which Nove Kinnisvarabüroo OÜ provides the sales appraisal service (hereinafter referred to as the “Service”).

  1. CONTRACT
    • Müügihinnangu koostamise teenuse osutaja on Nove Kinnisvarabüroo OÜ, registrikoodiga 16822997, asukohaga Harju maakond, Tallinn,  Lahepea 9-70, 10617 (edaspidi nimetatud Nove Kinnisvarabüroo).
    • The recipient of the service (hereinafter referred to as the “Client”) is a natural or legal person with whom Nove Kinnisvarabüroo has entered into an agreement for the provision of the service (hereinafter referred to as the “Agreement”).
    • The contract is concluded in a reproducible written form or orally. Oral agreements are confirmed by e-mail, if possible.
  1. SERVICE
    • Nove Kinnisvarabüroo provides the Client, who owns real estate, with a real estate owner's advisory service in determining the sale price of the real estate (hereinafter referred to as the "Service"). The specific manner and details of the provision of the Service are decided by Nove Kinnisvarabüroo.
    • In order to provide the service, the Client allows Nove Kinnisvarabüroo to conduct an inspection of the property. If the inspection of the property is not possible, the Client shall forward the images of the property to Nove Kinnisvarabüroo.
    • Providing a service to a person who has contacted Nove Kinnisvarabüroo with a request is a right, not an obligation.
    • A sales appraisal completed as part of the provision of a real estate owner's advisory service is not considered an expert appraisal of real estate.
    • The sales appraisal prepared as part of the property owner advisory service is not intended to assess and present the market value of the loan collateral to the lender.
    • The broker has the right to refuse to provide a free sales appraisal service in justified cases, including, but not limited to, if the appraisal of the property exceeds the broker's competence or if the provision of the service is not possible while ensuring the quality of the service.
  1. FEE
    • The service is free of charge for the property owner.
    • If during the provision of the Service or before the provision of the service it becomes clear that the Client wants and/or needs another service, Nove Kinnisvarabüroo has the right to direct the Client to receive another service and if the said service is subject to a fee, Nove Kinnisvarabüroo has the right to charge the Client for the service. The principles of calculating the fee for a paid service are agreed in a separate agreement.
    • Agreements regarding remuneration are confidential.
  1. CONFIDENTIALITY
    • Nove Kinnisvarabüroo is obliged to keep confidential any information it has received from the Client in connection with the provision of the Service, unless there is a direct obligation to disclose such information by law or if the Client has given consent (including in the Agreement) to disclose the information. The confidentiality obligation includes the fact of contacting Nove Kinnisvarabüroo to obtain the Service, the content of the Service and the amount of the Fee.
  1. PERSONAL DATA
    • Nove Kinnisvarabüroo has the right to collect, store, use and process the personal data of the Client and persons directly related to them in accordance with applicable laws on the protection of personal data, including for the management of customer relationships, the fulfillment of legal obligations and marketing purposes.
  1. RESPONSIBILITY
    • Nove Kinnisvarabüroo is not obliged to verify the accuracy of the information entrusted to it by the Client and is not responsible for the veracity of the data provided to it by the Client.
    • Nove Kinnisvarabüroo is liable for breach of obligations arising from the Agreement and damage caused during the provision of the Service only in cases of intent. Nove Kinnisvarabüroo is not liable for loss of income or damage caused by changes in the value of real estate.
  1. TERMINATION OF THE CONTRACT
    • The Client may cancel the Agreement at any time by notifying Nove Kinnisvarabüroo.
    • Nove Kinnisvarabüroo  võib Lepingu igal ajal üles öelda, teatades sellest Kliendile 2 päeva ette.
